The automatic stay goes into effect immediately
after a chapter 7 petition is filed.
This provides a relief for filers because it prohibits most creditors
from continuing to collect on your debt.
If a creditor calls, you have a powerful tool. Once you provide the creditor with the filing
number, place of filing, and date of filing, the creditor should refrain from
making further calls.
In some situations, however, a creditor may request
that the stay be removed. If the
bankruptcy judge grants the request, the creditor will be allowed to proceed
with collection efforts.
