Can I sue a school district for accusing my son of cheating on a test?

Q: Can I sue not only the school district but the teacher for accusing my son, without actually catching him cheating? It was a couple days later and because he and the boy that sits next to him had the same answers and missed the same questions and because my son didn’t know the answers to the first three questions, they stated he cheated. It is my opinion he should be actively caught cheating to blame him.

A: It is not a case that would generate interest from a civil attorney and I do not believe a crime was committed. I currently have a client whose son was accused of passing gas in 6th grade, and I basically told them the same thing when they wanted to go legal on some of the parents of the accusers and the teacher. There are lawyers who specialize in school law, who you may want to talk to if there are ongoing problems.
