Over 1100 federal claims have been filed against the 3M Corporation alleging that its Bair Hugger surgical warming blanket is causing deep joint infections in shoulder, knee, and hip replacement surgical patients. The federal multidistrict litigation is quickly adding up with 166 new claims filed in just the past month in The U.S. District Court, District of Minnesota.
The 3M Bair Hugger forced warm-air blanket is used during surgical procedures to keep the patient’s body temperature as close to normal as possible, which helps control bleeding and speed up recovery. The alleged problem with the blanket stems from how the forced warm air is fed into the unit. Multiple tests have shown that the product’s design disrupts the air flow in the surgical room, causing bacteria from the floor to become airborne. The contaminated air can then land in the surgical area and lead to life-threatening infections.
Plaintiffs in the product liability lawsuits also claim that the 3M Corporation continues to market the product despite warnings from its inventor that is it unsafe for use during joint replacement surgery. The New York Times reported the inventor’s warnings in 2010 that specifically asked hospitals to stop using the product in patients receiving joint implants. The Bair Hugger remains the industry’s leader in surgical warming blankets and continues to be used in four out of five hospitals across the United States.
Shoulder, hip, and knee replacement patients that had the Bair Hugger warming blanket used during their procedures have reported MRSA, staph and sepsis infections that have required extended hospital stays, additional surgeries, and increased medications. In some cases, the infections were so severe and hard to manage, the implants had to be replaced in a two-part surgical process that included removing the first implant, clearing the infection, and then surgically implanting a new joint. The most severe infections carry the risk of amputation of the affected limb.
