Some individuals may qualify for benefits based upon their deceased spouse or deceased former spouse’s work record. 1) The individual must be over the age of 50,
2) They have a medical condition or conditions which keeps them from working, AND
3) Their disability must have started either before or within seven years of their spouse’s death; or before or within seven years of their divorce from the former spouse. In the case of the former spouse only, the marriage must have lasted at least ten (10) years prior to dissolution.
