Connecticut Auto Accident Laws

Nationwide, there are generally three
types of "at-fault" laws that help to determine which party involved in
the collision was responsible for the accident.

These include:

  • Pure Contributory Negligence
  • Pure Comparative Fault
  • Proportional Comparative Fault

Here in Connecticut we practice what is called the Proportional Comparative Fault at 51 percent.
This means that if one of the parties involved in the collision is
found to be 51 percent (or more than half) at-fault for the accident,
they are unable to file a personal injury lawsuit against the other driver, regardless of the severity of their injuries.

How We Determine Who Is At Fault In A Crash

While pointing blame is easy to do after an accident, it’s often quite difficult to prove. At Jonathan Perkins Injury Lawyers, our accident attorneys
have decades of experience representing injury victims from car
crashes, and go to great lengths to ensure that your lawsuit is as
comprehensive as possible.

In
many instances, we will hire the services of various industry
professionals to help substantiate the claims that are being made in a
lawsuit.

Some of these can include (but are certainly not limited to):

  • certified doctors and related medical consultants
  • auto industry professionals
  • witnesses of the crash
  • car crash analysts

…..and other highly-regarded members of industry,

By
using their additional expertise, we are able to put together a robust,
strong argument for your MAXIMUM compensation claim. With this in mind,
we strongly believe that it is very important to thoroughly investigate
every element of a collision, to help increase the potential
compensation amount that we may be able to obtain for our client.

Connecticut Statute Of Limitations

If you are considering pursuing an
at-fault driver for compensation for injuries or damages that you may
have received as a result of their negligence, it’s very important to
note that Connecticut has a strict personal injury statute of limitations.

What this means is that an injury
victim only has two years from the date of the injury to file a claim.
However – if the injury could not have been discovered right away, a
victim has three years from the date of the injury to file an injury
lawsuit.

Here in Connecticut our car accident lawyers practice what is called the Proportional Comparative Fault at 51 percent.
This means that if one of the parties involved in the auto collision is
found to be 51 percent (or more than half) at-fault for the accident,
they are unable to file a personal injury lawsuit against the other driver, regardless of the severity of their injuries.
