Don’t Be A Victim Of Auto Accidents

The statistics for the rate, frequency and the extent of damage or injuries caused by auto accidents in the US is alarming. In 2005, a survey was carried out by the NHTSA (National Highway and Traffic Safety Authority) to determine the level of occurrence of auto accidents as well as the causes and impact of these accidents. The results revealed sobering statistics: over 6 million automobiles were involved in accidents with almost 2 million people left with varying degrees of injuries. Also, about 20,000 deaths resulted from these auto accidents. Given the significance of personal injury generally, what are the basic things that you need to know about car accidents and the possibility of making a claim if you are a victim of one?

Causes of Auto Accidents

According to a survey by the NHTSA, it was found out that the majority of the accidents resulted from an act of negligence on the part of one entity or the other. Entity in this case refers to an individual or a company. These causes can be categorized under several headings including:

Distracted Driving: this is a fairly common cause of auto accidents and several other cases of personal injury. Distracted driving results from any act that affects the concentration of the driver. Some of the very common distractions include calling or texting, looking at maps, applying makeup and a host of others. A lot of States have realized the role of driving while distracted and as a result, there are several laws that prohibit the use of phones while driving.

Failure to Adhere to Traffic Rules: a lot of drivers use the road with blatant disregard for rules and other road users. Some of the acts that result in auto accidents include speeding, the wrong use of road lanes, drunk driving, and disregard for traffic lights. All these points are acts of negligence.

Condition and Design of Roads: poor design, construction and maintenance of roads can also be responsible for motor vehicle accidents. In these cases, the government or the construction company is held responsible.

Making Claims

Before a case can be made for personal injury, the personal injury lawyer has to prove that the accident resulted from an act of negligence. Since car accidents also fall under personal injury cases, the same thing applies. This is why it is important to consult an experienced personal injury lawyer in car accident cases
