Personal Injury Law Firm Announces a Rapid Settlement for a Pedestrian Hit by Car in Queens

A car hit a pedestrian
walking across the crosswalk at the intersection of 80th Road and
Park Lane in Queens, New York, leaving him with a fractured cheekbone, a
laceration above his eye, and abrasions on his legs and face. The injured man retained our personal
injury law firm to represent him in an effort to collect compensation from the
man who hit him. After a careful investigation and thorough analysis of the
case, we successfully negotiated a rapid settlement with the defendant’s
insurance company for a good value.

The
Facts of this Pedestrian Car Accident Case

The
accident happened in Queens, where 80th Road, a one-way road,
dead-ends at Forest Park
and allows cars to turn either left or right onto Park Lane. Our client was
walking across Park Lane toward Forest Park when he was hit by a car attempting
to turn left onto Park Lane. The grille of the car hit the right side of his
face and body, causing him to drop to his knees, and leaving him with injuries
to his face and legs.

An
ambulance took him to Jamaica Hospital Emergency Room, where he was diagnosed
and treated for some of his injuries. He subsequently received treatment from
the Jamaica Dental Clinic for the injury to his cheekbone.

Proving
Liability in this Pedestrian Car Accident

People injured in car accidents in New York
State are entitled to New York No Fault Auto Insurance. We were able to
obtain No Fault insurance coverage from the defendant’s insurance company to
pay for our client’s medical bills. However, we contended that our client
deserved monetary compensation for the pain and suffering that he received as a
result of the injury. We therefore had to prove that the defendant was liable
for the incident.

It can
sometimes be difficult to prove liability in an intersection accident because
both parties often claim the right of way. During our investigation we
discovered that, while the driver had a green light, our client had a walk
signal, meaning that the driver had an obligation to wait for any pedestrians walking
across the crosswalk. Given these facts, we were able to hold the defendant 100
percent liable for the incident.

Maximizing Compensation for a Pedestrian Hit by
a Car

After building
a liability case against the defendant, we turned our attention to determining
the value of the damages our client suffered. We collected medical records and
interviewed him about the effect of the injury on his life. Our nurse prepared
a chronology of the diagnosis and treatment and produced background information
on his injuries.

We were
able to use this information to conduct a case law review of similar cases. With
data gathered from this review we calculated the probable value of the case at
trial and its settlement equivalency. We then used this information to justify
the largest compensation possible when we sent a Settlement Proposal to the defendant’s
insurance company. We were able to quickly negotiate a settlement that avoided
the cost of going to trial. Our client was happy with the settlement and for
the remarkable service we provided for him throughout the process.
