New York Considers Tougher Domestic Violence Laws

Domestic violence remains a
serious legal and public health problem across the United States, and as
a result of this persistent issue different state legislatures are
considering measures that would hopefully curtail this ongoing cycle of
dysfunction and abuse.  One such state is New York, which is considering
toughening the penalties for domestic abusers such that these laws
would hopefully deter some from abusing and prevent others from
repeating this offense

Specifically,
the state is considering establishing  the crime of "Aggravated Family
Offense" as a class E felony to ensure repeat offenders are prosecuted
as felons, as well as a new class A misdemeanor of "Aggravated
Harassment in the Second Degree.”  Being prosecuted as a felon would
mean that someone facing this charge could be sentenced to a prison term
of at least one year if not more.  In addition to these potential new
laws, there is legislation afoot that would help to prevent an accused
abuser from knowing the whereabouts of the alleged victim.

Most
people seem to expect these measures to pass through the state
legislature and to ultimately be signed into law by the governor. 
Domestic abuse is one of the few issues on a state level that seems to
transcend partisan bickering, and any level of protection provided to
those who are suffering at the hands of an abuser would be a positive
step for anyone involved.
