Personal Injury Cases and Motorcycle Accidents

Personal injury cases are fairly common in the US and there are several types of mishaps that can be categorized under personal injury. The severity and frequency of these eventualities differ with some of them accounting for a large proportion of these consequences. Motorcycle accidents are one of the hardest cases of personal injury for a variety of reasons. For starters, there is a bias against motorcyclists because of the largely wrong perception of motorcyclist as reckless drivers. As such, regardless of the circumstances surrounding the accident, winning claims in motorcycle accidents is often an uphill task. Sadly, the motorcyclist is actually the worst affected in most accidents and in light of this, it is important to know how to protect yourself and also get justice when wronged.

Causes of Motorcycle Accidents: Just like other types of vehicular accidents, several factors are responsible for motorbike accidents. Some of them include:

Defective Motorcycles: There have been several cases in which a defect in the design of motorcycles or any of the parts has resulted in crashes. In such cases, the manufacturer of the defective motorcycle or parts can be held responsible in the event that the cause of the accident can be traced to that defect. Apart from serving as a deterrent and reducing the reoccurrence of such an accident, getting compensation also provides the motorcyclist with adequate financial care required during hospitalization and support for the family in cases of wrongful death.

Negligent Driving: This is the primary cause of personal injury cases involving motorbike accidents. Research has shown that the greatest danger to motorcyclists is posed by negligent car drivers. This can happen in a variety of forms. For instance, several cases of motorcycle accidents have occurred due to the fact that car drivers claim that they couldn’t see the motorcyclist in their mirrors. This has often become a convenient excuse for a lot of negligent drivers. The truth however is that a lot of motorcycle accidents are caused by negligent car drivers.

Other causes of motorcycle accidents include potholes, hazardous roads, dangerous intersections, missing or damaged guardrails and several others.

The primary concern of every motorcyclist should be his or her safety and some tips include: the wearing of safety gear, riding within limits and staying visible at all times.
