Social Media and Your Personal Injury Claim

Social media has become more and more common. Most people use social media every day. People tend to broadcast otherwise private information on social media. A seemingly innocent photo or post can have a detrimental effect on your personal injury case, even if it is taken at a pain-free moment.

It is the job of defense counsel to find evidence to dispute your claim. Social media is a virtual hotbed of information for defense counsel. In Philadelphia, it is now a standard question asked in the written exchange of discovery called interrogatories. Counsel has a right to know what your social media presence is. In certain circumstances, your user name and password may have to be turned over. 

If you have a personal injury case, you should do your best to avoid posting anything on social media. Photographs can be misconstrued and posts can also be interpreted adversely. You should amend your privacy settings as well, but investigators can find ways into your profiles even if they are private.
